Booking Terms & Conditions
Welcome to Porthleven & Pasture
Thank you for choosing to stay with Porthleven & Pasture.
We take great pride in creating beautiful places to stay and helping our guests enjoy the very best of Cornwall.
These Terms & Conditions form the basis of your booking agreement with us and are intended to protect both our guests and our properties. By making a booking, you confirm that you have read, understood and accepted these Terms & Conditions on behalf of all members of your booking party.
1. Contract Formation
A binding contract is formed when:
We receive your booking request together with any required payment; and
We issue written confirmation of your booking.
The Lead Guest must be at least 18 years of age and is responsible for all members of the booking party.
These Terms and Conditions shall be governed by the laws of England and Wales.
2. Holiday Letting
The Property is let solely for holiday accommodation purposes.
This agreement does not create a tenancy and does not give rise to any statutory security of tenure.
3. Booking and Payment
A deposit of 25% of the total booking value is payable at the time of booking.
The balance is payable no later than six weeks before arrival.
Bookings made within six weeks of arrival must be paid in full at the time of booking.
Failure to pay the balance by the due date may result in cancellation of the booking.
4. Cancellation by Guests
We strongly recommend that all guests obtain suitable holiday cancellation insurance.
More than 60 days before arrival
All monies paid will be refunded less the booking deposit.
Between 30 and 60 days before arrival
If the Property is successfully re-let, monies paid will be refunded.
If the Property cannot be re-let, payments already made will be forfeited. Less than 30 days before arrival
No refund will be due unless the Property is successfully re-let.
All cancellations must be made in writing by email.
5. Cancellation by the Owner
If we are unable to provide the Property booked, we will endeavour to offer suitable alternative accommodation.
If no suitable alternative is available, all monies paid shall be refunded in full. Our liability shall not exceed the amount paid for the booking.
6. Arrival and Departure
Check-in is from 4.00pm.
Check-out is by 10.00am.
Alternative arrangements may only be made by prior agreement.
Late departure may result in additional charges.
7. Occupancy and Use of the Property
The maximum occupancy shown on the booking confirmation must not be exceeded at any time.
Only guests included within the booking may stay overnight unless agreed in writing.
The Property may only be used for holiday accommodation.
No parties, celebrations, receptions, events, commercial activities or gatherings are permitted without prior written consent.
8. Looking After the Property
Guests agree to:
Keep the Property clean and tidy.
Take reasonable care of the Property and its contents.
Report any damage, loss or breakages promptly.
Leave the Property in substantially the same condition as found.
Dispose of rubbish responsibly.
The Lead Guest is responsible for the conduct of all members of the booking party.
9. Damage Waiver & Security Hold
A non-refundable Damage Waiver Fee of £30 may be charged with each booking. This is intended to cover minor accidental damage occurring during your stay. The Damage Waiver does not cover:
Deliberate, reckless or negligent damage;
Damage caused by pets;
Excessive cleaning requirements;
Missing items;
Lost keys;
Smoking or vaping inside the Property;
Unauthorised guests;
Breaches of these Terms and Conditions.
In addition, Porthleven & Pasture reserves the right to place a refundable pre-authorisation hold of up to £250 on the Lead Guest's payment card before arrival.
This is not a charge and no money is taken unless required. The pre-authorisation may be used towards:
Property damage;
Missing items;
Excessive cleaning;
Pet-related damage;
Lost keys;
Breaches of these Terms and Conditions.
Where no deductions are required, the hold will automatically be released following departure in accordance with the payment provider's timescales.
10. Pets
Well-behaved dogs are welcome at selected Porthleven & Pasture properties by prior arrangement.
Guests bringing dogs agree to:
Declare all dogs at the time of booking;
Ensure dogs remain under control at all times;
Prevent dogs causing nuisance, excessive noise or disturbance;
Clean up after their dogs immediately;
Ensure dogs are clean and dry before entering the Property;
Not allow dogs on beds or soft furnishings unless expressly permitted;
Not leave dogs unattended within the Property unless agreed beforehand or appropriately crated;
Comply with any additional pet rules relating to the individual Property. Guests remain fully responsible for:
Pet-related damage;
Additional cleaning costs;
Damage to gardens, lawns, furniture, flooring, fixtures or furnishings;
Any additional costs arising from breaches of the property's pet rules.
Failure to comply with these pet rules may result in termination of the stay without refund.
11. Smoking and Vaping
Smoking and vaping are prohibited inside all Porthleven & Pasture properties.
Additional cleaning charges may apply where evidence of smoking or vaping is discovered.
12. Electric Vehicle Charging
Electric vehicle charging from domestic sockets is not permitted without prior written consent.
Unauthorised charging may result in additional charges.
13. Security and Access
Guests are responsible for all keys supplied.
Lost keys may incur replacement and security costs. We reserve the right to enter the Property:
In an emergency;
To carry out essential repairs;
To address safety concerns;
To investigate suspected breaches of these Terms.
Reasonable notice will be given where possible.
14. Health and Safety
Guests must:
Familiarise themselves with fire safety information;
Not interfere with smoke alarms, carbon monoxide detectors or safety equipment;
Supervise children appropriately at all times.
15. Photography and Commercial Use
The Property may not be used for:
Commercial photography;
Filming;
Advertising;
Marketing campaigns;
Business promotions; without prior written consent.
16. Breach of Contract
We reserve the right to terminate a booking immediately and without refund in the event of a serious breach of these Terms and Conditions.
Examples include:
Exceeding maximum occupancy;
Unauthorised parties or events;
Illegal activity;
Anti-social behaviour;
Excessive noise;
Significant damage to the Property.
Termination shall not affect our right to recover any losses, damages or additional costs.
17. Liability
Guests are responsible for their personal belongings. Vehicles and their contents are left entirely at the owner's risk.
Porthleven & Pasture shall not be liable for loss, damage, delay, injury or inconvenience arising from circumstances beyond reasonable control.
Nothing in these Terms excludes liability for death or personal injury caused by negligence.
18. Force Majeure
Neither party shall be liable for failure to perform obligations where such failure results from events beyond reasonable control including:
Fire
Flood
Storm damage
Utility failures
Government restrictions Pandemic events
Industrial disputes
War
Terrorism
19. Legal Provisions
These Terms constitute the entire agreement between the parties.
Any variation must be agreed in writing.
If any part of these Terms is found unenforceable, the remainder shall continue in full force.
No third party shall have any right to enforce these Terms.
These Terms are governed by English law.
The Courts of England and Wales shall have exclusive jurisdiction over any dispute.
